Delhi HC CJ S.A. Bobde – “We wish peace but courts are not equipped to handle such violence.”
Currently, Delhi is suffering from one of the most uneven happenings in the history of ideological differences since the 1983 massacre. The anti-CAA-NRC riots have taken the life of 46 people till now and a huge amount of property loss.
The Supreme Court, on Monday (2/03/2020), agreed to hear a plea seeking immediate registering of FIRs against political leaders and others who made inflammatory speeches that allegedly led to recent violence in Delhi.
Listing the petition filed by victims of last week’s Delhi violence, a bench headed by Chief Justice SA Bobde, however, said that the top court wishes peace but it is not equipped to prevent such violence.
Senior advocate Colin Gonsalves, representing the petitioners, told the bench that the pleas filed by victims had been deferred for four weeks by the Delhi High Court even as people are still dying. Gonsalves further said the pleas were adjourned.
“When people are still dying then why can’t the high court hear it urgently,” he said and urged the apex court to list the plea for hearing on Tuesday.
Responding to Gonsalves, the bench said that courts are not equipped to prevent riots and it is the job of the executive.
“We would wish peace but you know that there are limitations,” the bench said, adding, “Courts are not equipped to handle such kind of pressure.”
“We also read newspapers and the comments which are made,” the CJI said after hearing Gonsalves, PTI reported.
