Rape charged ‘Love Charger’ soon to be out on bail

The chief of Dera Sacha Sauda, Gurmeet Ram Rahim has recently applied for the parole for 42 days, for serving his agricultural fields. The man had been sentenced to 20 years of imprisonment, as he raped two of his women devotees. He was convicted for the crime in 2017. Chief Minister ML Khattar and two of his ministers, Krishna Pawar and Anil Vij are inclined towards promoting the release of Dera chief.

As far as the concept of Parole is concerned, Under the Haryana Good Conduct Prisoners (Temporary Release) Act, 1988, the state government can release a prisoner on parole in some of the specific cases –

  1. If a member of his family has died or is seriously unwell.

2) If there is a marriage of an important member of the house.

3) If the construction of the house, is the concern.

4) If the prisoner wants to get connected with agricultural activity for any other sufficient cause if the state government is satisfied.

While death, medical emergency, and marriage are common grounds in almost all states, Haryana has special provision for granting parole to a convict or an undertrial in custody for agricultural activities. It is on this ground that Ram Rahim has sought parole – to look after his fields in Sirsa district. Dera Sacha Sauda owns the land of 250 acres. The land is solely owned by the trust and Ram Rahim is its chief.

According to the law in Haryana, a prisoner can be released for a temporary period, for any activity associated with the agriculture or any agricultural activity on the father’s undistributed land. The fact is that the state government should be satisfied with the reason, to grant parole to Ram Rahim. The jail superintendent has told the district magistrate, that his conduct in the jail was decently well and has not violated any rule, during his confined state.

The maximum period of parole is 42 days. Responding to the parole application by Ram Rahim, Haryana CM Khattar said a parole application is filed before the jail superintendent who SENDS it to the deputy commissioner. Then a report is taken from the superintendent of police and, in the eventually, a recommendation is made by the divisional commissioner. He said the parole issue was with the DC-SP level and there was no time for the Sirsa SP or DC would submit their report.

Things will move ahead after a report is submitted, Khattar said before, more substantially, adding that his government would make establish an opinion regarding law and order if needed.

A senior advocate of the high court expressed that no DM would take the risk of releasing him and questioned that “who will be responsible if does not return back to the jail?”. There is a big question mark on his attempt for gaining parole as, the government of Haryana may be changed after the election of October there, and logically, it could be the plan of Ram Rahim to exit the jail forever. The criminal cannot be trusted, as there is no need for him to join the zone, in which he will be doing agricultural activities, which does not even belong to him.
